1. Definitions
- “Cohomes” refers to Cohomes Pte Ltd, the e-commerce platform facilitating rental listings and management for co-living spaces in Singapore.
- “Operator” refers to Coliving Operators, Landlords, Property Agents, or Real Estate Salespersons listing properties on Cohomes.
- “Tenant” refers to any individual booking or renting a property through the Cohomes platform.
- “Tenancy Agreement (TA)” refers to the legal agreement entered into between the Tenant and the Operator for the rental of a property.
2. Operator Registration and Use
2.1 Operators must register for an account via the online subscription form provided by Cohomes.
2.2 By registering, Operators agree to pay a Platform Fee of 4% of the total rental value of each successfully closed tenancy agreement. Example: For a 24-month rental at $1,000/month, total rental value = $24,000. Platform fee = 0.04 × $24,000 = $960.
3. Property Listing and Content Responsibility
3.1 Operators are responsible for the accuracy, authenticity, and validity of all property listings and uploaded images.
3.2 Property images must be original or appropriately authorized for use. Cohomes may remove any images or listings found to be invalid or unauthorized.
3.3 Cohomes may assist with listing uploads upon request. Operators agree to allow 2–3 working days for processing. However, Operators remain fully responsible for listing accuracy.
3.4 By submitting listings, Operators grant Cohomes the right to use property images and descriptions for marketing and advertising purposes across digital and physical media.
4. Verification and Documentation
4.1 Operators are responsible for verifying all documentation provided by Tenants and ensuring their eligibility to reside in Singapore (e.g. work passes, student passes).
4.2 If Operators have their own tenancy agreement format, it must be provided to Cohomes for uploading and electronic filing.
4.3 Operators acknowledge that Cohomes is not liable for the authenticity or validity of documents provided by Tenants.
5. Tenancy Agreement (TA) and Booking Process
5.1 TAs are to be signed online via the Cohomes platform.
5.2 A booking is only confirmed when:
- The TA is signed by both parties.
- Tenant documentation is verified.
- Payment of the security deposit, first month’s rent, and stamp duty fee is made via Cohomes.
6. Payment Terms
6.1 Payments to be collected via Cohomes include:
- Security Deposit
- First Month’s Advance Rent
- Stamp Duty Fee
6.2 Cohomes will hold the above payments (funds) in escrow until Tenant’s move-in date.
6.3 If no refund claim is raised within three (3) working days after the scheduled move-in, funds (after deducting platform fee and stamp duty) will be disbursed to the Operator within seven (7) working days.
7. Service Fees and Access
7.1 Operators agree to allow Cohomes’ service staff access to premises to assist with Tenant move-in and move-out processes, subject to scheduling and with a nominal service fee (to be advised separately).
8. Listings Management
8.1 Cohomes will conduct regular removals of invalid or outdated listings in its website / portal.
8.2 Operators are required to promptly inform Cohomes of any change in listing availability or details.
9. Indemnity and Limitation of Liability
9.1 Operators undertake to indemnify Cohomes against any claims, losses, or liabilities arising from inaccurate or misleading property listings.
9.2 Cohomes is not liable for any disputes between Operators and Tenants, including tenancy breaches, non-payment, or property damage.
10. Confidentiality and Data Protection
10.1 Cohomes will manage all Tenant and Operator data in accordance with the Singapore Personal Data Protection Act (PDPA) and the platform’s Privacy Policy.
11. Amendments
11.1 Cohomes reserves the right to revise these Terms and Conditions by updating the version on its website.
11.2 Continued use of the platform after amendments constitutes acceptance of the revised terms.
12. Governing Law
12.1 These Terms and Conditions are governed by and construed in accordance with the laws of Singapore.
12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
